What is the Road Accident Fund (RAF)?

The Road Accident Fund is an organisation that provides compulsory cover to all South African road users (citizens and foreigners) against injuries sustained or death arising from accidents involving motor vehicles, within the borders of South Africa. The Road Accident Fund compensates victims of motor vehicle collisions who have suffered personal injury and indemnifies the person who caused the accident. The Road Accident Fund is funded by means of a fuel levy on motor vehicle fuel.

Who May Claim?

Any person or the dependants of any person that was involved in a motor vehicle collision as a result of which he/she sustained bodily injuries or suffered death, provided that the person claiming compensation was not the sole cause of the collision. This includes:

  1. Drivers
  2. Passengers
  3. Pedestrians
  4. Cyclists
  5. Motorcyclists
  6. Pillion passengers on a motorcycle
  7. A dependent of a deceased breadwinner
  8. A person who paid for funeral expenses

Any person under the age of 18 must be assisted by a parent, legal guardian or curator ad litem.

Time Frames to Submit a Claim (Prescription)

a. Identified Claim:

Where the identity of the driver or the owner of the negligent motor vehicle is known, the claim must be lodged with the Road Accident Fund within three (3) years from the date of the accident and summons must be issued within five (5) years from the date of the accident.

b. Unidentified Claim

Where the identity of the driver or the owner of the negligent motor vehicle is unknown, the claim must be lodged with the Road Accident Fund within two (2) years from the date of the accident and summons must be issued within five (5) years from the date of the accident.
